The Committee had undertaken a site visit.

 

As referred to in the update sheet, further comments were still awaited from Natural England regarding the Applicant’s Assessment of Likely Significant Effects. Accordingly officers recommended that the application be deferred until such time as Natural England were able to give their view.

 

RESOLVED:

 

That the application be deferred in order to obtain further comments from Natural England in respect of the Applicant’s Assessment of Likely Significant Effects.

The Committee were addressed by Mr. Andrew Jamieson in objection to the application and by Mr. Mark Iveson in support of the application.

 

The Committee had undertaken a site visit.

 

RESOLVED:

 

1.         That in consideration of the report to Committee dated 13.3.2018 and this report, approval be GRANTED, subject to:

·         A Section 106 obligation being entered into by the supermarket provider as set out within the report;

·         A Section 106 obligation being entered into by the developer of the residential elements of the scheme as set out in the report;

·         Repetition of the same conditions 21, 44 and 45 attached to HPK.2015/0571;

·         Amendments to conditions 21, 44 and 45 of planning consent HPK/2015/0571 to reference the amended plans and wording

 

2.         In the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions / Informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued, the Operations Manager – Development Services be given delegated authority to do so in conjunction with the Chairman of the Development Control Committee, provided that the changes do not exceed the substantive nature of the Committee’s decision.

Cllr. Young confirmed that he had Called-in the matter to Committee on behalf of Chapel-en-le-Frith Parish Council, but that he had taken no part in discussions at a parish level regarding the application.

 

RESOLVED:            

 

1.    That the application be REFUSED for the reasons and policies contained in the report.

 

2.    That in the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions / informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued, the Operations Manager – Development Services be given delegated authority to do so in consultation with the Chairman of the Development Control Committee, provided that the changes did not exceed the substantive nature of the Committee’s decision.
