Proposed construction of an industrial unit to replace existing buildings.  Unit to contain a trade counter and offices.

The Committee had undertaken a site visit.

 

The Committee were addressed by Richard Grundy in objection to the application and Robert Hopkins (applicant).

 

RESOLVED:

 

1.         That the application be approved as set out in the report, subject to:

(i)         an additional condition to require submission of an environmental management plan, to include amongst other matters, the provision of wheel washing facilities and dust control;

(ii)        an amendment to the condition relating to opening times to include deliveries in order to prevent deliveries outside of opening times;

            Both requirements imposed in order to safeguard amenity of local residents and in the interests of highway safety.

 

2.         That in the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions / informatives /  planning obligations or reasons for approval or refusal) prior to the decision being issued, the Head of Development Services be delegated authority to do so in consultation with the Chairman of the Development Control Committee, provided that the changes do not exceed the substantive nature of the committee’s decision.

Application for approval of reserved matters (access, landscape, appearance, layout and scale) in relation to HPK/2014/0573

 

Applicant:        Mandale Homes North Yorkshire Ltd.

 

The Committee had undertaken a site visit.

 

Due to adverse weather conditions, the applicant was unable to attend the meeting.  Under the circumstances, the Chair allowed the Head of Development Services to read a statement on behalf of the applicant to the Committee.

 

The Head of Development Services made reference to the amended recommendation on the update sheet and recommended that the delegation to approve be also subject to no objections and any conditions required by the Lead Local Flood Authority.  An additional condition was also recommended to remove permitted development rights in part to prevent garage conversions to ensure the appearance of the frontage of the street at plots 3 – 7 is retained as a matter of good design in the street scene and to ensure retention of parking in the interests of highway safety.

 

RESOLVED:

 

1.         That authority be delegated to the Head of Development Services, in consultation with the Chair of the Committee, to approve the application, subject to:

            (i)         the conditions as set out within the report;

            (ii)        no objection being raised by the Housing Officer;

(iii)       any conditions required by Derbyshire County Council Highway Authority;

(iv)       no objections and any conditions required by the Lead Local Flood Authority;

(v)        the removal of permitted development rights in respect of garage frontages and a condition to require the vertical boarding of garage doors;

(vi)       a condition to require additional tree planting at a ratio of 2:1 in the area of woodland to the north and north-western boundary of the site;

(vii)      the amendment of the boundary treatment condition to include some hedging not boarding, and that provision be made for hedgehog runs in order to preserve wildlife routes;

           

2.         That in the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary of add conditions / informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued (including to ensure any additional affordable units required to meet the policy requirements and are shown on the layout plan), the Head of Development Services be delegated authority to do so in consultation with the Chair of Development Control Committee, provided that the changes do not exceed the substantive nature of the committee’s decision.

The Committee had undertaken a site visit.

 

The Head of Development Services made reference to the amended recommendation on the update sheet.

 

RESOLVED:

 

1.         That authority be delegated to the Head of Development Services, in consultation with the Chair of the Committee, to approve the application subject to:

(i)         the conditions as set out in the report;

(ii)        the Environment Agency raising no objections;

(iii)       the additional condition recommended by Derbyshire Wildlife Trust relating to the protection of breeding birds;

 

2.         That in the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions / informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued, the Head of Development Services be delegated authority to do so in consultation with the Chair of Development Control Committee, provided that the changes do not exceed the substantive nature of the committee’s decision.

The Committee had undertaken a site visit.

 

The Committee were addressed by Pat Rattigan (applicant).

 

The Head of Development Services made reference to the amended recommendation on the update sheet.  The Head of Development Services advised that a variation of S106 agreement would also be necessary to accommodate the change to the location of the affordable housing, and also sought delegated authority to refuse the application should the S106 be not completed within the time period of the application or agreed extension of that time period.

 

RESOLVED:

 

1.         That authority be delegated to the Head of Development Services, in consultation with the Chair of the Committee, to approve the application subject to:

            (i)         no objections being raised by the Highway Authority;

            (ii)        the additional conditions recommended by Derbyshire Wildlife Trust;

(iii)       the final conditions to be agreed with the Head of Development Services and the Chair of the Committee;

(iv)       the completion of a variation S106 agreement to accommodate the change in the location of the affordable housing;

 

2.         That authority be delegated to the Head of Development Services, in consultation with the Chair of the Committee, to refuse the application should the S106 agreement be not completed within the time period of the application or agreed extension of that time period;

 

3.         That in the event of any changes being needed to the wording of the committee’s decision (such as to delete vary or add conditions / informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued, the Head of Development Services be delegated authority to do so in consultation with the Chair of the Committee, provided that the changes do not exceed the substantive nature of the committee’s decision.

The Committee had undertaken a site inspection.

 

The Committee were addressed by Dave Bennett (on behalf of High Peak Access) and Chris Smith (agent).

 

The Senior Planning Officer made reference to the amended recommendation on the update sheet.

 

RESOLVED:

 

1.         That approval be granted as set out in the update sheet; and

 

2.         Concern being expressed regarding traffic movements within the site it was noted that there was already a condition that would be re-imposed in relation to this permission requiring detail to be submitted dealing with public realm works and layout and that this would include a requirement for :traffic calming measures on the access road between the Howard Town Mill site and the application site;

 

2.         That in the event of any changes being needed to the wording of the committee’s decision (such as to delete, vary of add conditions / informatives / planning obligations or reasons for approval / refusal) prior to the decision being issued, the Head of Development Services be delegated authority to do so in consultation with the Chair of the Committee, provided that the changes do not exceed the substantive nature of the committee’s decision.
