Minutes:

Councillor Sizeland declared a disclosable pecuniary interest in agenda item 9, HPK.2017/0620 Buxton Football Club, Silverlands, Buxton (reason: holds shares with Buxton Football Club) and withdrew from the meeting during the consideration and voting thereon

 

Councillor Thrane declared an ‘other’ interest in agenda item 11, HPK/2018/0032 Buxton Opera House, Water Street, Buxton (reason: High Peak Theatre Trust Board Member appointed by HPBC) and withdrew from the meeting during the consideration and voting thereon

The Committee had undertaken a site visit.

 

The Committee were addressed by Councillor Pritchard (ward councillor) in objection to the application and by Robert Walker (Agent).

 

RESOVLED:

 

1.    That the application be refused as set out in the report;

 

2.    That in the event of any changes being needed to the wording of the Committee’s decision (such as to delete, vary or add conditions/informatives/planning obligations or reasons for approval / refusal) prior to the decision being issued, the Operations Manager – Development Services be delegated authority to do so in consultation with the Chair of the Development Control Committee, provided that the changes do not exceed the substantive nature of the Committee’s decision.

The Committee had undertaken a site visit.

 

The Committee were addressed by Simon Artiss on behalf of the applicant.

 

The Planning Officer advised that since the publication of the update sheet, a further 3 letters of objection had been received, expressing the following areas of concern:

·         impact of the proposed development on doctors, dentists and schools in the area

·         Heathfield Nook Road is gridlocked

·         Concerns around contamination and landfill run off and possibly on water quality

·         Loss of wildlife and trees

·         The site is not designated for housing in the local plan and part of the site is not within the development boundary

 

RESOLVED:

 

1.    That following the expiry of the neighbour consultation period on 3 May 2018 and no new, substantive matters being raised, that authority be delegated to the Operations Manager – Development Services, in agreement with the Chair to approve the application, subject to:

a.    A deed of variation to the existing Section 106 Undertaking attached to outline consent HPK/2014/0403 to reference the new consent;

b.    Repetition of the same conditions attached to outline consent HPK/2014/0403

c.    Amendment to condition 4 of outline consent HPK/2014/0403 to reference the amended plans

 

2.    That in the event of any changes being needed to the wording of the committee’s decision (such as to delete, vary or add conditions  informatives/ planning obligations or reasons for approval or refusal) prior to the decision being issued, the Operations Manager – Development Services be delegated authority to do so in consultation with the Chair of the Committee, provided that the changes do not exceed the substantive nature of the Committee’s decision.
