REASONS FOR RECOMMENDATION
The report explains a new licensing requirement for pavement cafes that is proposed by Government to assist businesses in the hospitality trade with the economic recovery. The report sets out a first draft of the processes that could be applied by the Council to consider applications and recommends a scheme of delegation for the issuing and refusal of licences, and for the fee that should be charged in respect of these new licences.
This is a new statutory function for the Council and a process must be agreed for determination of applications received. There is discretion offered to Councils as to whether, and at what level, to set the fee for determination of such applications.
1. That a fee of £100 for the determination of applications for Pavement Licences be adopted by the Borough Council, but that licences will be free for charities and not for profit organisations;;
2. That the scheme of delegation detailed at section 7.9 of the report be adopted;
3. That, with the agreement of the Chair of Community Select Committee, the decision be exempt from call-in due to the urgent nature of the report.
