DECISION NOTICE

Rose and Crown, 440 New Street, Biddulph Moor, Staffordshire, ST8 7HZ.

Introduction

The hearing was called to consider an application for the Variation of a Premises Licence by the Rose and Crown, 440 New Street, Biddulph Moor, Staffordshire, ST8 7HZ. 

No interests were declared.

The Sub-Committee considered the written report, relevant legislation, s182 guidance and Staffordshire Moorlands Statement of Licensing Policy as well as verbal submissions made at the meeting before coming to a decision.

Decision

That the application for variation of licence (as proposed by the applicant and as set out below) be approved subject to:

  • The external outdoor seating area and shelter of the premises shall only be open for use between the hours of 10.00hrs and 23:00hrs.

 

  • That no licensable activities shall take place in the external area until a noise impact assessment has been carried out by an independent and suitably qualified acoustic consultant in order to draw up a noise management plan to be approved by the Environmental Health department of Staffordshire Moorlands District Council, such plan to include:
    • All recommendations made by the acoustic consultant.
    • Prominent, clear and legible notices to be displayed at all exits and in the external areas requesting that customers respect the needs of local residents and to leave the premises and area quietly.
    • That the licence holder or his representative shall conduct regular checks of the areas outside the premises while the external areas are in use and shall take steps to reduce the level of noise where it is likely to cause disturbance to local residents.  A written record shall be made of these assessments in a log book that shall be kept at the licenced premises and produced to the Licensing Authority on request.
    • A complaint log shall be used to record any complaints received regarding use of the premises and any steps taken to resolve the complaint. The log shall be kept at the licenced premises and produced to the Licensing Authority on request.
    • At no time shall speakers or other devices be used to amplify music or any other sound after 9pm in the external areas.

The licensee shall comply with the provisions of the noise management plan at all times the premises are open.

  • Live music events in the outside area of the premises shall be limited to 1 per month and no more than 12 events annually.
